1. Acceptance of Terms
By accessing or using Modojo AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Modojo AI is an AI-powered video editing platform that enables users to create, edit, and export professional videos using artificial intelligence technologies including script generation, voiceover synthesis, and automated motion design.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 13 years of age to use the Service.
- One person or entity may not maintain more than one account.
4. Credits and Payments
- The Service operates on a credit-based system. AI features consume credits based on usage.
- Free accounts receive a limited number of credits upon registration.
- Additional credits can be purchased. The price (in the currency shown at checkout) is displayed before you confirm each purchase.
- Paid plans (Pro, Enterprise) grant their features for 30 days from the date of purchase; afterwards the account reverts to Free unless renewed.
- We reserve the right to modify pricing at any time with reasonable notice.
5. Payment Methods
- Payments are accepted online by bank card — Visa and Mastercard — processed securely by our payment provider monobank.
- Charges are made in the currency shown on the checkout page; the exact amount is displayed before you confirm the payment.
- We do not store your full card details; card data is handled by the payment provider in accordance with PCI DSS.
6. Service Delivery & Provision Time
- Modojo AI is a digital service — there is no physical shipment or delivery of goods.
- After a successful payment, the purchased credits are added to your account and the corresponding features become available immediately and automatically (typically within a few seconds, and in any case no later than 24 hours).
- If credits or access are not granted after a confirmed payment, contact us using the details in the Contact section and we will resolve it promptly.
- Generated videos and assets are produced on demand within the editor and are available for download directly in your account.
7. Refund & Cancellation Policy
- The Service delivers a digital product (credits / AI generation) that is made available immediately, so payments are generally non-refundable once the corresponding credits or plan access have been granted.
- Refund for an unusable paid plan: if you purchased a paid plan (subscription) and were unable to use the Service for 7 consecutive days because of technical failures or major bugs on our side that we were not able to resolve, you are entitled to a refund of that plan. This is the primary case in which we issue refunds.
- Service not delivered: if you were charged but the credits or plan access were never provided to your account, you are entitled to a full refund of that payment.
- Outside of the cases above, purchases (including used credits and consumed plan time) are non-refundable, except where a refund is required by applicable law.
- Subscription cancellation: paid plans do not auto-renew; they simply expire after 30 days. You can stop using the Service at any time and may delete your account by contacting support.
- How to request a refund: contact us at the email/messengers listed in the Contact section with your order details (date, amount, account email) and a short description of the issue. Approved refunds are returned to the same card used for payment, typically within 1–14 business days depending on your bank.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to promote illegal activities
- Generate content that is defamatory, obscene, or infringes on others' rights
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools (bots, scrapers) to access the Service without permission
- Circumvent any credit, usage, or access restrictions
9. Intellectual Property
- Your Content: You retain ownership of the original content you upload. By uploading content, you grant us a limited license to process it for the purpose of providing the Service.
- Generated Content: Videos and content generated using our AI tools are owned by you, subject to any third-party rights in the underlying assets.
- Our Platform: The Service, including its design, code, and AI models, is protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the platform.
10. AI-Generated Content Disclaimer
Content generated by AI may not always be accurate, appropriate, or free from bias. You are solely responsible for reviewing and approving any AI-generated content before publishing or distributing it. We do not guarantee the accuracy or suitability of AI outputs.
11. Limitation of Liability
To the maximum extent permitted by law, Modojo AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.
12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Local project data & your connection: Your video projects are processed in your browser and are not stored on our servers. A stable internet connection is required throughout generation and editing. If your connection is interrupted for one minute or longer, we cannot guarantee that the video or project in progress will be saved or recoverable, and any unsaved work may be lost. You are responsible for maintaining a reliable connection and for saving or exporting your finished work.
13. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms. You may delete your account at any time by contacting support.
14. Modifications
We may change or update these Terms at any time. When we do, we will notify you of the changes — by posting the updated Terms on this page with a new "Last updated" date, and, for material changes, by an in-app notice and/or an email to the address on your account. Continued use of the Service after the changes take effect constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
